Client Contract for LDP Weddings
Terms and information for scheduling wedding photography with Lauren Day Photography
By signing this contract, you agree to the following:
Lauren Burrows and Lauren Day Photography (hereinafter referred to as “the Photographer” or “Lauren” and “LDP,” respectively) consider a wedding date to be booked only when a date has been confirmed, this contract has been signed and returned, and a booking deposit has been received. LDP reserves the right to book another Client for the desired date until contract is signed and received.
The Client agrees to pay the full amount of the chosen package plus any applicable sales tax. 40% of the package price is due upon booking, and the remaining 60% of the package price plus sales tax is due no later than 14 business days prior to the wedding date. Cash, credit card, and checks are acceptable forms of payment. There is a 4% service fee associated with all credit card transactions. Booking retainer must be received within 10 business days of contract being signed. After the signing of this contract, should the Client cancel any time 30 days or more prior to the wedding, he or she remains financially responsible to pay 60% of the package price. Should the Client cancel within 30 days of the wedding, he or she is financially responsible to pay 75% of the package price. All previously made payments at the time of cancellation are nonrefundable. The payment may be credited toward one classic LDP session for up to 30 days after the wedding date provided that the session is booked by and for the person or persons who have signed this contract, and is nontrasnferrable.
Package prices are subject to change without notice; however, Client will receive the price agreed upon at time of booking. The total cost of predetermined packages is non-negotiable, and LDP is responsible only for what is listed on the wedding package info sheet provided to the Client unless otherwise agreed upon by the Photographer.
All additional items such as photo CDs, USB flash drives, prints, photo books, canvas prints, etc. can be ordered through LDP at additional costs or through third-party vendors.
An Engagement Session is included with all LDP Wedding packages. This gives the Photographer and the Client(s) an opportunity to work together before the wedding day to ensure utmost comfort and ease day-of. Engagement sessions include 45-90 minutes of camera time (dependent upon agreed-upon wedding package), choice of location, one outfit change if desired, a downloadable online gallery with 50-80 edited high-resolution photos, and limited rights to the photos (detailed below in the “DELIVERY/IMAGE COPYRIGHTS” section of this contract.)
In the event of poor weather conditions or other factors that prevent the engagement photo shoot from happening on agreed-upon date, Lauren and Client will work together to reschedule the session within two weeks of original date if possible.
If the Client wishes to postpone and reschedule an agreed-upon session date after this contract has been signed, he/she must notify Lauren at least TEN DAYS in advance.
Lauren will work with the Client to choose a location that best suits what the Client is looking for. The Client may choose his/her own location or take a suggestion from Lauren. Lauren reserves the right to refuse any location for any reason, and in this instance she will suggest alternative locations. Travel fees may apply for locations more than 20 miles away from Franklin, Ohio.
More complete information for engagement sessions can be found at www.laurendayphotography.com/contracts. The information in the BOOKING, PAYMENT, CANCELLATION AND RESCHEDULING, and CLIENT SIGNATURE sections is overruled by the information in this contract.
The Client must provide the Photographer with a timeline of the wedding day at least three weeks before the wedding. Lauren will work with the Client to help create the timeline if the Client would like help. Lauren will help keep time day-of in order to ensure the least amount of stress possible.
The Client must also provide the Photographer with all addresses at which she is expected to be present. Typically, getting-ready photos are focused on the bride and her bridesmaids, but they may also be taken of the groom and his groomsmen as well if specifically requested and if reasonable within the guides of the timeline.
Ceremony photos may be affected by the amount of light available in the ceremony location. If the Client has any questions about lighting at the ceremony venue, he/she should contact Lauren, and she will provide assistance. The Client understands that if he/she chooses to use dim lighting for the ceremony, the photos may be affected and not be up to par with LDP’s normal photo style.
Family photos often take place directly after the ceremony and before the reception. The Client should provide Lauren with a list of desired family group photos so that we can efficiently get through the list. Lauren will provide a sample list to the Client. The Client should inform all family members who are to be in these photos to gather at the agreed-upon location after the ceremony.
Bridal party photos may be taken before or after the ceremony, dependent upon whether or not the bride and groom will see one another before the ceremony. This is the decision of the Client(s), and LDP will work with whatever they should decide within reasonable limits.
Reception photos are taken as the reception events happen. The Client(s) and the Photographer consent to cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. The Client(s) also agree to give the Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare e.g. bouquet throwing, cutting the cake, speeches, etc. as well as a copy of the timeline for the reception. Please note that not all guests at weddings will have their photos taken. It is the responsibility of the Client(s) to notify the photographer of special guests that should be photographed.
Guests will not be photographed while eating, and the Photographer often uses this time to take detail shots of rings and decorations as well as to take a break to eat. The Client agrees to provide both the Photographer and second shooter with a meal at the time the guests eat; this may be the same meal provided to guests or a vendor meal. If there is a DJ, the Photographer will work with him/her to ensure a smooth reception. Should the Client(s) desire more camera time after the Photographer’s hours are over, they may ask the Photographer to stay at a rate of an additional $200/hour, due before receipt of digital files.
LDP is not responsible for missed shots due to guests getting in the way, acts of God, equipment malfunction, or any other factors in or out of the Photographer’s control.
EMERGENCIES AND LIMIT OF LIABILITIES
In the unlikely event that the Photographer is injured, becomes too ill, is prevented by an Act of God, or has an emergency that prevents her from photographing the wedding, Lauren will make every effort to provide the Client with a substitute photographer. If, for whatever reason, this is not possible, responsibility and liability is limited to the return of all payments received for the package purchased. LDP takes the utmost care with respect to exposure, transportation, processing, and archiving the photographs. However, in the unlikely event that photographs become lost for any reason, stolen, or destroyed for reasons within or beyond Lauren's control, Lauren's liability is limited to the return of all payments received from the Client.
CREATIVE LICENSE & MODEL RELEASE
Images are taken and edited at the discretion of Lauren Burrows, and final images are chosen at her discretion. The Photographer will do her best to accommodate the requests of the Client(s) within reason according to Lauren’s discretion. Lauren Burrows solely reserves the creative right to edit and release only those images deemed creditable as professional in quality and within artistic standards. Under no circumstances will the RAW images from a session or wedding be released to the Client.
LDP and its agents hold the right to use any images for commercial or marketing purposes unless explicitly requested otherwise by the client. In no way will LDP release Client's images to any other individuals except for advertising and marketing purposes, photographic print competitions, and/or publication submissions. If the Client prefers to opt out for security reasons, he/she should contact Lauren directly.
Prints, photo books, canvas prints, magazines, cards, and other products are available for order from both the engagement session and the wedding through LDP at additional costs. If the Client is interested in ordering through LDP they may do so through the gallery. In addition to product prices, the Client is responsible for shipping and handling and sales tax costs involved with the order.
The Client agrees to release the photographer from any liability for any claims based whatsoever upon aging or wear of the photographs after delivery. Lauren is not responsible for manufacturing defects from third party vendors, but will assist the Client to ensure he or she is happy with the products.
Please note that LDP is not held responsible for any errors in print quality when the Client chooses to order from a third party lab. To receive images that are consistent with the file, it is suggested that the Client order prints directly through the gallery .
Each client will receive his/her final digital images from the wedding via a downloadable online gallery within 2 months of the wedding date. Black and white copies of some photos will be provided in substitution or addition to the color images. Upon receipt of the digital files, the Client receives limited rights to reproduce the photos. LDP grants the Client the rights to print or post the photos as they are received for personal use only. LDP retains the copyright for the images, and the ownership of the images is shared between Lauren and the Client. Commercial use of images is strictly prohibited for the Client.
Client is not permitted to alter, edit, filter, or crop the images in any way. The purpose of this policy is to ensure that any photo that is associated with LDP reflects the quality standards and consistency of Lauren Day Photography. If the Client would like a specific image converted to Black & White or if he/she has any questions about cropping or editing, Lauren should be contacted before any action is taken.
